Release of Liability, Assumption of Risk, Promise Not to Sue, and

Agreement to Pay Claims

 

In consideration for being allowed to participate in Walk the World, LLC, (DBA:  TerraTreks) Dolomites Trek 2020 (referred to as “Activity”), on behalf of myself and my next of kin, heirs, and representatives, I release from all liability and promise not to sue  Walk the World, LLC, DBA: TerraTreks, hereinafter referred to as Walk the World, LLC, its officers,  employees, agents, contractors, and volunteers (collectively Walk the World, LLC),  from any and all claims including claims of Walk the World, LLC negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss I may suffer because of my participation in this Activity, including travel to, from, and during the Activity.

 

I am voluntarily participating in this Activity.  I am aware of the risks associated with participating in adventure travel, mountain trekking and hiking, and travel to, from, and during the Activity, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death.  I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel, weather conditions, or the condition of the Activity location(s), including but not limited to, trails, roads, gondolas, and lifts.  I understand that Activity involves strenuous physical activity lasting several hours in duration each day, and over several consecutive days.  I understand hiking and trekking are dangerous activities known to cause physical harm, which may result in permanent injury and/or death.  I also understand that Activity is conducted outdoors, and weather conditions are unpredictable and can subject me to extreme heat and/or cold, hail, sleet, lightning, and other weather for which I may not be prepared.  Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this Activity, including travel to, from, and during the Activity.

 

I agree to hold Walk the World, LLC harmless from any and all claims, including attorney’s fees, or damage to my personal property, that may occur as a result of my participation in the Activity, including travel to, from, and during the Activity.  If Walk the World, LLC incurs any of these types of expenses, I agree to reimburse Walk the World, LLC.  If I need medical, hospital, or other interventions or treatment, including medical evacuation, I agree to be financially responsible for any costs incurred as a result of such treatment. I have been advised that my health insurance may not cover adventure travel activities or cover costs incurred in a foreign country. I also acknowledge that I have been advised to purchase Adventure Travel Insurance, which covers the cost of injury and/or illness, including but not limited to medical, hospital, and evacuation costs, should I be injured or become ill. 

I understand the legal consequences of signing this document, including  (a) releasing Walk the World, LLC from all liability, (b) promising not to sue Walk the World, LLC and (c) assuming all risks of participating in this Activity, including travel to, from, and during the Activity.

 

I also grant and authorize Walk the World, LLC the right to take, edit, alter, copy, exhibit, distribute, and make use of any and all pictures, or video taken of me to be used in and/or for legally promotional materials including , but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits, and submissions to journalists, websites, social media sites, and other print and digital communications, without payment or any other consideration.  This authorization extends to all languages, media, formats, and markets, now known or hereafter devised.  This authorization shall continue indefinitely, unless I otherwise revoke in writing. I understand that these materials shall become the property of Walk the World, LLC, and will not be returned.

 

I hereby hold harmless, and release Walk the World, LLC from all liability, petitions, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate.

 

I understand that this document is written to be as broad and inclusive as legally permitted by the State of California.  I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms. 

 

I have read this document and am signing it freely.  No other representations concerning the legal effect of this document have been made to me.
